At a press conference, Uddhav Thackeray blamed the Election Commission for not taking cognizance of over 19 lakh affidavits sent by his party in the MLA disqualification petition case.

Uddhav Thackeray, who recently received a blow from Maharashtra Assembly Speaker Rahul Narvekar in the Shiv Sena MLA disqualification petition case, held a press conference on Tuesday in which he presented video evidence and documents related to the inter-party clashes of 2013 and 2019. Elections and resolutions passed in the National Executive meeting.

Uddhav Thackeray accused the Election Commission of “wasting the party’s time and money” by asking for an affidavit of support from party workers. He said, “We had submitted more than 19 lakh affidavits, what did they do with them? Why were we asked to submit them? Many of you may have read the news that many of the affidavits are false and inaccurate. This government sent police to the homes of my party workers to verify them. If the Election Commission has not taken cognizance of it, then why were we asked to submit it? Therefore, I said that we should file a case against the Election Commission.

Assembly Speaker Narvekar had recently said in his order that the Uddhav Thackeray faction of Shiv Sena has no evidence to prove that the party chief has the authority and power to expel anyone from the party. He also cited that the latest updated copy of the party’s constitution, available with the Election Commission of India, is from 1999. Therefore, he rejected the Uddhav faction’s claim of amendments made to the Constitution in 2013 and 2018, about which they were informed. election Commission.

The tagline given by Shiv Sena UBT for the press conference was “Satya Eka Aur Vichar Kara” (Listen to all the facts and think on it). Advocate Aseem Sarode and advocate Rohit Sharma, representing Thackeray, addressed the gathering at the NSCI Dome in Worli on Tuesday. Both the lawyers explained to the party supporters, workers and citizens how the Speaker of the Assembly has acted outside the framework drawn up by the Supreme Court in the disqualification case of MLAs.

Analyzing the Speaker’s order, Sarode said, ‘Although the 10th Schedule (of the Constitution) talks about anti-defection law, but with his last order the Assembly Speaker has shown the way how anyone can easily change party. . ,

He further said that a legislative party, which is formed by the MLAs for a period of five years, is no bigger than a political party, the importance of which is mentioned in the Constitution. “The whip can be appointed only by the political party and not by the legislature party,” he said.

Advocate Anil Parab presented all the evidence and documents which showed that Shiv Sena had conducted internal elections as per the Election Commission rules, while Narvekar claimed that there was no record of the amendment made in the Shiv Sena constitution in 2013. And in 2018.

In 2013, after the death of Shiv Sena supremo Bala Saheb Thackeray, Uddhav was made the party president and the post of party chief was permanently sealed in Bala Saheb’s memory. This proposal was passed unanimously in the party’s national executive meeting. In the video of the meeting, leaders like Gajanan Kirtikar and Ramdas Kadam are seen sitting on the stage with Uddhav.

Shiv Sena UBT also claimed that the same meeting was also attended by Rahul Narvekar who was a member of the party at that time. But now it has refused to accept that the party has followed all the rules. Parab also showed the documents of the proposals which were submitted to the Election Commission.

Parab further showed a video of the 2018 national executive meeting in Worli, in which Eknath Shinde was promoted to the post of “party leader” on the recommendation of party president Uddhav Thackeray. “The Supreme Court in its remarks had mentioned considering the constitution and leadership structure of Shiv Sena but the Speaker did not follow it at all. Narvekar has said that despite all the records being handed over to him after 1999, there are not enough records regarding the party’s constitution and leadership structure.

Rohit Sharma, who also represented Uddhav Thackeray in the court, said Narvekar’s decision was “unconstitutional and against the law because a political party is not a temporary body”. “If a political party contests elections but does not have a legislative party, does it mean that the party has no existence? certainly not. That’s why a political party is important,” Sharma explained.
