In a rare move, a Pakistani court sentenced a Sindh man to 80 lashes for refusing to acknowledge the paternity of his child and lying about his ex-wife’s adultery.

According to Dawn News, District and Sessions Judge (Malir) Shehnaz Bohyo convicted Fareed Qadir and his legal children under Section 7(1) of the Qazf (Had Execution) Regulations 1979 Cut off ties and make false accusations against your ex-wife. on Monday.

The court ruled that following his conviction, his evidence was inadmissible in any court after the conviction was confirmed by the Federal Shariah Court.

“As the accused was only sentenced to caning…he will remain on bail, provided that he agrees to appear before the court at a time and place to be specified by this court for the execution of the caning after confirmation of conviction and sentence.” The Court of Appeal, which submitted the Bail amount of Rs.,” the judgment said.

The prisoner’s ex-wife, who got married in February 2015, said they lived happily together for a month and gave birth to a baby girl in December 2015.

However, her ex-husband did not provide alimony or take her back to his home.

When she moved to Family Court, the judge ruled in her favor and directed the offender to provide maintenance for his daughter and ex-wife.

However, during the process of applying for the death penalty, the husband made two applications to the court, requesting DNA testing of the baby girl and to sever ties with the daughter. These applications were subsequently withdrawn by him.

However, the complainant made an application seeking legal redress due to serious allegations made against her by her ex-husband.

During the trial, the defendant denied the allegations against his ex-wife and said she only lived with him for six hours after their marriage before leaving the home and never returning.

However, the court noted that the defendant neither testified under oath nor produced any witnesses to support his claims, adding that the defense also did not provide any evidence that the defendant apologized or made an application regarding the misunderstanding.

The court said the accused admitted in his recorded statement under Section 342 of the Criminal Procedure Code that a baby girl was his legitimate daughter.

Prosecutor Saira Bano said that in her 14 years as a lawyer, she had not witnessed any conviction for caning under Article 7 of the Qafz Act.

She explained that the imposition of the 80 lashes was subject to confirmation by the Court of Appeal or otherwise.

She believes the recent conviction may be the first case of corporal punishment in decades.
