Delhi High Court says Arvind Kejriwal’s challenge to timing of arrest unsustainable (File)

New Delhi:
In a huge setback for the Aam Aadmi Party, the Delhi High Court has ruled that Arvind Kejriwal’s arrest in the Delhi liquor policy case is valid. The court dismissed the chief minister’s petition against his arrest and said his remand cannot be termed illegal.

What the court said:

  1. The Delhi High Court said it was unsustainable for Arvind Kejriwal to challenge the timing of his arrest ahead of the Lok Sabha elections without any malice on the part of the Enforcement Directorate.

  2. The ED has enough material to arrest Arvind Kejriwal. Talking about the need for arrest, the Delhi High Court said Kejriwal’s non-participation in the investigation and the delay caused by him also affected those in judicial custody.

  3. Judges are bound by law and not by politics. The high court said the judgment was written based on legal principles and not political stance.

  4. Political considerations cannot be brought to court. The court said the case before it was not a conflict between the central government and Arvind Kejriwal but between him and the education ministry.

  5. The court said it was concerned with constitutional morality, not political morality.

  6. The court held that the ED was able to provide sufficient materials, statements from approvers and their own candidates, to show that he received funds for the Goa elections. The court said it completed the funding chain for Goa elections.
