New Delhi:
Chief Justice DY Chandrachud has said the Supreme Court will direct the recount of votes from last month’s mayoral election, and this includes eight – all in favor of the Aam Aadmi Party – which were declared “invalid” by Returning Officer Anil Masih. , which were captured on camera. Marking ballot papers.
A bench led by Chief Justice DY Chandrachud on Tuesday examined eight ballot papers and took strict action against Mr Masih, who was removed by the Bharatiya Janata Party from its minority cell last week.
The BJP had claimed a surprise victory in the January elections after eight votes were rejected.
The court began today’s hearing by asking Mr Masih to explain how the eight ballot papers were “defaced”; Mr Masih said he marked the papers because he saw they had been “defaced”.
Mr Masih told the court that he wanted to ensure that these “spoilt” ballots were not counted.
“Yesterday you said these ballots were tampered with. Can you show us where?” the Chief Justice asked, as he showed the eight to Mr Masih and his lawyer, as well as other parties to the hearing.
“All eight have given seal of approval for Kuldeep Kumar (AAP candidate)… The votes have been cast for Mr Kumar. What does he (Mr Masih) do… He puts a line. Just a line, like That is seen in this video.”
On this point, senior lawyer Abhishek Singhvi, appearing for Mr Kumar, said Mr Masih’s actions amounted to “contempt of court”. “This is a heinous crime…” he declared.
Mr Singhvi said, “This person (Anil Masih) had the courage to do it on video… keep quiet (about it) and then come to court and think he can get away (with it). Was misleading.” to continue.
