A Delhi court has issued a civil summons to food delivery app Zomato, seeking a restraining order against the company from continuing to provide a service that allows users to order “hot, authentic food” from “iconic restaurants” across the capital.

The court was hearing a plea filed by a Gurgaon resident who alleged that Zomato was engaging in “false and fraudulent” practices by delivering fresh food from well-known restaurants under its sub-category “Dilli ke Legends”.
In an order passed recently, civil judge Umesh Kumar said: “Issuance of summons for proceedings and notice of application.”
According to the complaint, Sourav Mall placed an order from three different restaurants in Jama Masjid, Kailash Colony and Jangpura on October 24 last year. He later traced the delivery partner and found that the order was from an “unidentified and unnamed” restaurant. Selected. place instead of the original restaurant.

The complaint states: “Why is food being picked up from a nearby location where there is no restaurant partner outlet? Why is the food not delivered in the restaurant partner’s original packaging? How is it guaranteed that the food is prepared by the restaurant partner? How is it guaranteed that the food is fresh? , hot?”
It added that it was “baffling” how Zomato could deliver from an iconic restaurant in Delhi to locations in Gurgaon and Noida within 30 minutes.
“Such representations to Zomato users, customers or patrons are indeed intended to deceive the public at large,” the complaint said.
The defense is a “representative action” brought against a number of affected individuals under the Code of Civil Procedure (CPC).
