Supreme Court to hear teenage rape survivor's plea to abort pregnancy at 28 weeks

New Delhi:

The Supreme Court is due to hear on Monday a 14-year-old alleged rape survivor’s plea to terminate her 28-week pregnancy.

According to the Supreme Court website, Chief Justice DY Chandrachud and Justice JB Pardiwala will hear her case as the first item on Monday.

On April 19, the Supreme Court ordered a medical examination based on her mother’s plea challenging the Bombay High Court’s decision to refuse to allow the termination of the pregnancy due to the advanced stage.

It has asked Mumbai’s Sion Hospital to provide a report on the physical and psychological conditions the girl may develop if she receives medication to terminate the pregnancy or is advised not to terminate the pregnancy.

The judge has directed the hospital director to constitute a medical committee and submit its report to the court for the next hearing on April 22.

The lawyer appearing for the petitioner said that the minor is 28 weeks pregnant and is currently in Mumbai.

Additional Solicitor General Aishwarya Bhati is representing the government in the matter.

Under the Medical Termination of Pregnancy (MTP) Act, the upper limit for termination of pregnancy is 24 weeks for married women and special categories of women including rape survivors and other vulnerable women such as disabled women and minors.
