The Allahabad High Court has held that “kanyadaan” is not essential for a marriage ceremony under the Hindu Marriage Act and only “saptapadi” is an essential ceremony.
Justice Subhash Vidyarthi made the remarks while hearing a revision petition filed by Ashutosh Yadav, who said that under the Act, his marriage The ‘kanyadaan’ (bride sending away) ceremony had to be performed but it was not performed in his case.
In its order on March 22, the court said that the Hindu Marriage Act only provides for “saptpadi” (seven steps or saat pheras) as the basic rituals of marriage.
The court said that taking into account the totality of the circumstances, a kanyadan ceremony was not required for the solemnization of a Hindu marriage.
“Whether the kanyadan ceremony was performed or not is not important for the fair verdict of the case and, therefore, witnesses cannot be called to prove this fact under Section 311 of the CrPC,” the court said.
Mr. Yadav challenged the additional hearing order passed by the Lucknow bench on March 6 while challenging the criminal case filed by his in-laws.
