Delhi Chief Minister Arvind Kejriwal will move the Supreme Court against the Delhi High Court’s decision to dismiss his plea against the Enforcement Directorate’s arrest in the excise policy money laundering case, sources said on Tuesday.

Sources said the Aam Aadmi Party disagreed with the Delhi High Court’s ruling.

The Delhi High Court on Tuesday dismissed Chief Minister Arvind Kejriwal’s challenge to the Enforcement Directorate’s arrest in the GST policy case and said Kejriwal’s arrest was not against the law and remand cannot be Called “illegal”.

A bench of Justice Swarna Kanta Sharma said the ED had sufficient material which led them to arrest Mr Kejriwal. Mr Kejriwal’s non-participation in the inquiry and the delays caused by him have also affected those in judicial custody.

Materials collected by the Enforcement Directorate revealed that Arvind Kejriwal conspired and was actively involved in using and concealing proceeds of crime. The ED case also revealed his involvement in his personal capacity as well as as the convener of the Aam Aadmi Party.

The court further observed that the court held that the accused had been arrested and his arrest and remand must be reviewed in the light of law and not in light of the timing of the election. The court said Kejriwal’s challenge to the timing of the pre-election arrest was unsustainable in the absence of any ill-intention on the part of the education ministry.

Mr. Kejriwal was arrested by the Enforcement Directorate on March 21 in connection with the excise policy case.
