The High Court dismissed the Congress’ plea challenging the reassessment process of the Income Tax Department.

The Delhi High Court today dismissed a plea filed by the Congress party challenging the reassessment proceedings initiated against it by the Income Tax Department.
“We dismiss the writ petition,” a bench of Justices Yashwant Varma and Purushaindra Kumar Kaurav said while pronouncing the judgment. A detailed order is awaited.
The High Court on March 20 had reserved its order on a plea filed by the party against tax reassessment proceedings initiated by the authorities for three consecutive years (2014-15, 2015-16 and 2016-17).
The party challenged the reassessment process, claiming it was time-barred.
Senior advocate Abhishek Singhvi, representing the Congress party, submitted that the tax reassessment process was restricted and the IT department may go back up to six assessment years.
However, the IT department claimed that the tax authorities did not violate any statutory provisions and as per the recovered materials, the party had “escaped” income of over Rs 520 crore.
Recently, the High Court refused to interfere with the Income Tax Appellate Tribunal’s order staying the Income Tax Department’s notice to Parliament seeking recovery of over Rs 100 crore in unpaid taxes.
The assessing officer raised a tax demand of over Rs 100 crore for the assessment year 2018-19, when the income assessment was over Rs 199 crore.
