A bench of Justices Surya Kant and Joymalya Bagchi said the case should not be given undue publicity, news agency PTI reported, adding that it would consider framing guidelines to prevent such incidents in future.
The bench held that acts such as shouting or throwing objects in the court clearly constitute contempt, however, it is the prerogative of the presiding judge to take action under the law.
“Issuing a contempt notice will only give undue importance to the lawyer who threw the shoe at the CJI and will extend the expiry date of the incident,” the bench was quoted as saying by PTI.
The judges said that the episode should be allowed to “die its natural death”.
The remarks came while hearing a petition filed by the Supreme Court Bar Association (SCBA) seeking contempt action against 71-year-old lawyer Rakesh Kishore, who was involved in the October 6 incident.
