OpenAI calls Elon Musk’s claims in court documents ‘incoherent’

OpenAI has slammed Elon Musk’s accusations against it, saying in a court filing that the billionaire entrepreneur’s claims are “based on convoluted and often incoherent factual premises.”

The strongly worded filing is the company’s first response to a lawsuit Musk filed in February against the company, CEO Sam Altman and President Greg Brockman Legal response. Musk claimed that the startup had strayed from its mission of building responsible artificial intelligence and held Microsoft Corp., its largest investor, responsible.

OpenAI emphasized in the filing that it did not violate its agreement with Musk because “as the complaint itself indicates, there was no founding agreement and no agreement with Musk.” OpenAI also issued a memo to employees last week and blog posts denying Musk’s claims.

“The relief Musk seeks is as extraordinary as his claims,” OpenAI said in a filing in state court in San Francisco. “Musk is requesting an order forcing OpenAI to reorganize and distribute its technology under the terms of his fictitious contract. “

OpenAI and Musk have been engaged in a highly publicized battle long before the case came to court. Before his feud with the company, Musk was an early backer of the startup and a member of its founding team. Musk criticized OpenAI’s commercialization strategy and close relationship with Microsoft.

OpenAI said in its blog post that Musk had previously pushed for the company to become part of his car company Tesla Inc. The company also said in the filing that Musk supports OpenAI operating as a for-profit company, but only if he can control the company. “Seeing the remarkable technological progress that OpenAI has made, Musk now hopes that he can succeed as well,” the company’s attorneys wrote.

Musk and OpenAI did not immediately respond to requests for comment.

The dispute between the two tech giants touches on core issues of the safety and accessibility of artificial intelligence and has spilled over into the larger world of startups. Billionaire venture capitalist and OpenAI investor Vinod Khosla told Bloomberg TV on Monday that Musk can’t sue his path to general artificial intelligence.

OpenAI also argued in the filing that Musk would use the lawsuit to gain access to OpenAI’s “proprietary records and technology” if pretrial fact-finding and information sharing, known as “discovery,” begins in the case, warning that ” “Discovery” requirements “need to be strictly regulated.”

OpenAI also asked the court to designate the lawsuit as a “complex case,” which is to avoid unnecessary burdens on the court and the parties involved, according to California rules. Cases are generally considered complex and assigned to specially designated judges when they involve complex technical issues as well as multiple parties and numerous claims.
