The Delhi High Court on Wednesday heard the presentations on behalf of Baramulla MP Abdul Rashid Sheikh, aka Engineer Rashid, who are praying for amendment in the order to tolerate expenses to participate in Parliament in custody.
It was presented by the senior advocate on behalf of Rashid that he was unable to represent the people of his constituency due to the condition imposed on him.
Engineer Rashid is demanding amendment on the order of March 25, which is Rs. Make a condition to deposit. 4 lakhs etc. as expenses for travel.
The Division Bench which includes Justices Vivek Chaudhary and Anoop Jeram Bhambhani listed the case for further hearing on August 12.
Senior Advocate N. Hariharan appeared for Engineer Rashid along with Advocate Wikunt Oberoi. He presented that he is demanding amendment in the order regarding expenses.
Justice Chaudhary said that you are reviewing the earlier order.
The court asked the lawyer whether it is worth maintaining for amendment or in review ?? Can we hear or you can go before the big bench.
Senior Hariharan said that I am not challenging the merit of the order. I just want to amend the cost paid.
I am not challenging the order; I am not reviewing the court. I am just demanding an amendment, the senior advocate presented.
Senior advocate Siddharth Luthra appeared for the NIA and presented that the order passed by the court was a consent order.
Senior advocate of Engineer Rashid presented that interim bail was argued. We agreed to custody parole, not the cost of travel.
They were earlier given parole without a cost. They were asked to pay the expenses for the third time. Earlier, he was allowed to participate in Parliament without any cost.
The bench said that whenever the parole of custody is given, the expenses are borne by the person who was relieved.
The bench said that we have mentioned the order of the Supreme Court in the Tahir Hussain case. It has been said that some expenses are calculated. How can this be appropriate in front of us?
In the last hearing, another bench has asked the lawyer for Rashid to suppress the amendment application before the respective bench that passes the order on 25 March. (ANI)
