The Bombay High Court (HC) recently allowed a man to meet his two-month-old child after he learned that his wife was trying to flee the country with the child through forged documents.

A division bench of the high court, comprising Justice AS Gadkari and Justice Shyam Chandak, was hearing the habeas corpus petition filed by the man.

The couple got married in India under Muslim personal laws.

The high court noted in its order that it had made three attempts to resolve the dispute between the couple keeping in mind the best interests of the children.

However, the same approach did not produce any positive results.The judge noted that the child attended all hearings

After the couple got into an argument, the husband filed a complaint against the woman and her mother. The Andheri District Court granted bail to the two on January 1, 2024.

In its order, the court noted that while on bail, the woman and her mother tried to manipulate certain documents with the intention of leaving India for Uzbekistan using emergency travel documents.

As a result, another First Information Report (FIR) was registered against them. Investigation into the two FIRs is ongoing and a police report is yet to be filed.

The man’s lawyer, Jitendra Tiwari, said he will file a case in the Mumbai Family Court seeking custody and/or visitation of the child. Before doing so, he requested that the minor be granted visitation rights.

The judge agreed and granted the father the right to meet his two-month-old child every other day from 4 to 5 pm until he files appropriate proceedings before the family court and passes necessary orders.
