Congress moves Delhi High Court in tax penalty case

The Congress on Monday moved the Delhi High Court challenging the Income Tax Appellate Tribunal’s (ITAT) plea to impose penalty for discrepancies in certain tax returns.

Senior advocate Vivek Tankha mentioned the matter before a bench of Acting Chief Justice Manmohan and Justice Tushar Rao Gedela.

Mr Tanka said this was a matter of urgency as the party’s accounts had been frozen.

Acting Chief Justice Manmohan agreed to hear the case on the same day if the petition complied with the rules.

Last week, the ITAT dismissed an appeal by Congress to impose penalties for discrepancies in tax returns from previous years.

The party had earlier said the Information Technology Tribunal’s order freezing its funds was an “attack on democracy” as it was made ahead of the Lok Sabha polls.

According to sources, the court dismissed the Congress’ appeal against the Rs 210-crore penalty imposed by the Income Tax Department.
