Karnataka draft bill for 5% disability quota in private sector and 10% in education

The Karnataka government has released a draft bill proposing mandatory 5% reservation for persons with disabilities in all private sector establishments with 20 or more employees.

The Bill, which is currently in the public consultation stage, mandates a 10% quota for students with disabilities in every course in all educational institutions.

The Karnataka Rights of Persons with Disabilities in Employment and Education Bill, 2025, published in the Official Gazette on November 21, seeks to enhance protections in accordance with the Rights of Persons with Disabilities Act 2016 as well as the United Nations Convention on the Rights of Persons with Disabilities.

According to the draft bill, private establishments with 20 or more employees will have to reserve 5% of the sanctioned posts for people with disabilities, including direct recruitment and regular posts.

The state regulatory authority’s formula must be used by employers. allot reserved postsbetween disability groups. The quotas will be implemented in phases, and annual compliance reports will be required.

The bill also outlines penalties for non-compliance from 10,000 5 lakh, along with corrective measures and public disclosure of non-compliance. Additionally, fraudulent disability claims may result in fines. Rs 1 lakh and imprisonment up to two years, while compliant organizations can get government incentives such as procurement priority and certification.

It also requires employers to provide reasonable accommodations such as assistive devices, flexible work arrangements, and physical modifications. “If an employer denies an accommodation citing undue hardship, the reason must be given in writing and may be reviewed by the proposed state regulatory authority. Except as necessary for safety or legal compliance, information related to a disability may be disclosed only with informed consent. Employees who receive a disability cannot be demoted or terminated and must be reassigned or placed in an additional position”, it reads.

The new draft also states that all educational institutions reserve 10% seats for students with disabilities and must provide extended time and accommodation to writers during admission, classes and examinations.

Students with disabilities will get concessions on age and cut-off marks, and educational loans will be made accessible at concessional rates with simplified documentation and dedicated facilitators.
