The Delhi High Court on Thursday issued a notice to the NIA on a petition to challenge the allegations against MP Engineer Rashid. It is listed on 6 October.
Meanwhile, the Delhi High Court has transferred the petition to amend the roster bench in the detention parole order. It is listed for hearing before the Roster Bench on 6 August, including justice Anoop Jeram Bhabhi under the order of the Chief Justice.
A division bench of Justices Vivek Chaudhary and Shalinder Kaur issued a notice to the NIA on a petition challenging the order to prepare the allegations against MP Engineer Rashid. The High Court has sought a response. Special Public Prosecutor (SPP) Akshai Malik accepted the notice.
Regular bail plea is also pending before the bench and will be heard together on the next date. Hearing a petition seeking interim bail/custody parole for the entire Parliament session, the High Court said that arguments are similar, so it is better that you press for amendment of the earlier order.
Senior Advocate N Hariharan accepted the suggestion and urged to list the matter before the roster bench which had crossed the earlier order.
MP Rashid Engineer sought an interim bail to participate in the Parliament session.
In the final hearing on 29 July, the court asked the lawyer that the application for amendment of the earlier order is still pending. The issue is the same with the latest application. We cannot hear the same issue again. The lawyer for the petitioner said that, alternatively, interim bail has been sought.
The court said that it was previously considered by the previous Division Bench. You should suppress the amendment petition. The lawyer of the accused presented that the first interim bail was argued. The Delhi High Court on July 25 issued a notice to the NIA on an interim bail plea. He has demanded interim bail to participate in the Parliament session.
On 22 July, the Special NIA court rejected its petition for interim bail. However, he was given custody parole. In Patiala House Court, Special NIA judge gave the detention foot parole to engineer Rashid from 24 July to 4 August.
This detention parole was given for the period of a parliamentary session. Rashid has to bear the cost and follow other situations. Now, he has said that detention parole was provided for a limited period. It is presented that if they are not granted interim bail, they may be given custody parole from 23 July to 21 August to attend the monsoon session of Parliament.
He has also sought a direction to separate the order to tolerate expenses for travel and other arrangements.
Rashid is in judicial custody in a terrorist funding case associated with Hafiz Saeed. Engineer Rashid was represented by senior advocate N Hariharan with advocates Aditya Wadhwa, Vikant Oberoi and Nishita Gupta.
It was before the special court that it was argued that the trial court granted interim bail for the state election campaign on September 10, 2024, which was extended three times. Therefore, it cannot be considered a security threat.
In addition, the Delhi High Court had allowed him to participate in Parliament twice on 10 February and 25 March, during which he duly participated, the lawyer presented.
Nia had opposed the petition, presenting that an interim order should not be given. If he is allowed to participate in custody, he should pay travel expenses. Counsels for Rashid are opposing paying any travel expenses, as they are trying to participate in Parliament as their public duty, not for their personal work.
