What is known about the sentence of Brian Kohberger that hearing for the murder of four Idaho students

Boise, Idaho (AP) – For many universities of Idaho students, a “Shelter in Place” text message from school was the first indication that something badly went wrong at the Rental House near the campus on 13 November 2022.

Madison Mogan, Xana Karnodal, Kayley Gonclaves and Ethan Chapin were killed in Moscow, Idaho Ghar on King Road. The killer, Brian Kohberger convicted crimes earlier this month and is expected to be sentenced to four consecutive lives.

But there are still more questions in the disturbing case. On Wednesday, there are some things to know for the hearing of Kohberger’s sentence.

A argument was given before a test

30-year-old Brian Kohberger was arrested about six weeks after the murder and was accused of four cases of first-degree murder. He initially exercised his constitutional right to remain silent when he was asked to enter a petition, so a judge entered a noted petition on his behalf.

Latah County Prosecutor Bill Thompson soon announced that if Kohberger was convicted, he would seek a death sentence. Investigators stated that Kohberger’s DNA was found on a knife sheath at home, the surveillance video showed a car matching a car near Kohberger at the time of the murders, and cell phone data showed it several times before the attack.

After expressing concern that Kohberger’s defense lawyers expressed concern that the court would not be able to find sufficiently fair gamblers in the rural agricultural community of Moscow. But they failed to remove the death sentence from the table, and they were not able to prevent important evidence such as DNA from being admitted to the test.

Both sides reached a petition earlier this month. The prosecutors agreed not to seek their execution, accepting the crime in lieu of Kohaburger and forgiving their right to appeal. Instead, both sides agreed to recommend that he serves four consecutive lives without parole for murders.

During the hearing of the plea on July 2, Judge Steven Hippler said that when he comes to the deals of such a petition, he does not have much. The court may not need an prosecutor to search for a death sentence, and the primary role of a judge in the petition hearing is to determine whether the defendant petition is voluntarily and wisely arguing. Hippler determined that there was a case for Kohberger, and accepted his guilty petition.

The families of the victim were divided on how they felt about the petition deal.

Investigators did not reveal what they think that the works of Kohberger could be motivated.

At the time of the murders, Kohberger was a criminal justice student at Washington State University, and Thompson said that he used his knowledge about forensic investigation to cover his track by deep cleaning his vehicle after the crime.

The case attracted widespread interest and judges feared that the publicity could damage the right to the Kohberger’s fair testing. A comprehensive gag was ordered and hundreds of court documents were sealed from a public point of view.

After Kohbarger convicted, Hippler agreed to raise the gag order. After hearing of the sentence, the documents will be ignored but it will take time. It is not clear how many answers they can have.

Kohberger can punish or refuse

The families of the victims and the surviving roommates will get a chance during the sentence hearing that the murders have described them. Because there are many of them, the hearing can increase in Thursday.

Kohberger will also have the opportunity to speak – a process called “right to allotment”. The defense use their statement to express regrets, ask for mercy, or whatever the court thinks should be heard before the court is sentenced. But because the 5th amendment of the US Constitution is guaranteed the right to remain silent while sentencing the guarantee of the 5th amendment, they also cannot speak even during the hearing.

Kohaburger does not have to say anything – and the judge cannot force him.

Many people, including President Donald Trump, have urged the judge to somehow explain to Kohberger themselves.

Trump wrote online on Monday, “I hope to at least, Judge Kohberger explains why he committed these terrible murders.” “There are no explanations, nothing is there.”
