Who owns the Tesla name in India? Delhi HC stops Tesla Power from using ‘Tesla’ brand

The court ordered Tesla Power to abide by its earlier promise that it would not manufacture or sell electric vehicles under the Tesla trademark. It also stopped the company from promoting the EV using the name.

Additionally, Tesla Power is barred from manufacturing, selling, or marketing batteries using the Tesla mark.

Tesla Inc has approached the Delhi High Court alleging trademark infringement, arguing that the use of the name Tesla Power was misleading consumers.

The US-based automaker told the court that buyers were mistakenly believing that Tesla Power’s automobile and inverter batteries were manufactured by Musk’s company.

Tesla also presented that Tesla Power had started manufacturing electric scooters despite previously denying plans to enter the EV segment.

Tesla Power is currently engaged in the business of batteries for automobiles and inverters. The dispute was referred to arbitration, but negotiations failed, leading to the present interim directions.

The court said it would continue to monitor compliance as the trademark case moves forward.
