A division bench of Justice AK Jaishankaran Nambiar and Justice Jobin Sebastian expressed strict rejection on the Center’s affidavit, arguing that there was no legal provision to waive loans for disaster affected persons.
“Please tell the central government that it has thwarted the people of Kerala,” the court told the government’s lawyer, calling the Center a “bureaucratic nonsense”.
“It’s not about whether the Sangh can work or not, but whether they are willing to work. If you are not keen to work, then have the courage to say this. Who are you trying to fool?” The bench said.
The judges said that funds were sanctioned by the Center for Assam and Gujarat, despite the floods were not classified into a serious category. The court said that Kerala respects the Constitution and the separation of the powers but now it will not issue instructions to the Central Government.
Justice Nambiar commented, “We don’t need the union donations,” he ordered banks to stop the loan recovery immediately from the affected persons until next notice. The bench said that banks would be made parties in the case and will be asked to explain whether their intention is to waive the loan completely or partially.
The matter will be heard again in two weeks.
