In a statement released on October 20 (US time), the immigration body said that under the proclamation, new H-1B petitions filed on or after 12:01 a.m. Eastern Day Time on September 21, 2025 must be accompanied by an additional $100,000 payment as a condition of eligibility.
Therefore, this applies to people outside the United States. As a result, other constituents including current H-1B holders and foreign nationals on student visas and those already present in the United States are not required to pay the hefty fee, which is approximately ₹90 lakh in Indian currency.

The USCIS update further states, “Pursuant to Section 1(c) of the Proclamation, for H-1B petitions subject to the Proclamation, petitioners must submit a copy of proof of payment from pay.gov or proof of fee exemption from the Secretary of Homeland Security at the time the H-1B petition is filed. Petitions subject to the $100,000 payment that are filed without proof of payment or an exception grant. are made, will be rejected.”
While the Trump administration’s reforms to the visa program, in its current form, will continue to act as a major barrier to new applicants, this clarification comes as the Trump administration was sued by the US Chamber of Commerce over making changes to the H-1B visas, making them more restrictive, thereby encouraging the hiring of locals who are US citizens.
