The Central Bureau of Investigation (CBI) on Tuesday said it will file a special leave petition (SLP) before the Supreme Court as soon as possible against the Delhi High Court order granting bail to former BJP leader Kuldeep Singh Sengar in the Unnao rape case.
In a statement, the agency said it has examined the High Court’s decision and has decided to challenge the suspension of Sengar’s sentence.
“The CBI has studied the orders of the Division Bench of the Delhi High Court in the Unnao rape case and has decided to file an SLP before the Hon’ble Supreme Court at the earliest,” the agency said.
The CBI said it had strongly opposed the bail plea before the Delhi High Court along with the victim’s family citing security concerns and alleged threats.
“The CBI has filed timely replies and written arguments in this case. The victim’s family has also opposed the plea citing security and threats,” he said, adding that he would “immediately challenge the order.”

The bench noted that Sengar has already served a sentence of more than seven years and five months, adding that the perception of danger alone was insufficient to refuse to suspend the sentence under Section 389 of the CrPC. It also directed the Deputy Commissioner of Police to ensure the safety of the victim.
Sengar was convicted in December 2019 in the case of raping a minor girl in 2017. The trial was transferred from Uttar Pradesh to Delhi on the orders of the Supreme Court. His appeal has been tentatively listed for January 16, 2026.
Despite bail in the rape case, Sengar will remain in jail as he is serving a separate 10-year sentence in a case related to the custodial death of the victim’s father.
