But as soon as the local council learned of the pregnancy, legal action was launched to find the child’s parents.
It approached the High Court urging it to direct the man to undergo a DNA test to determine whether he was D’s father.
However, a judge rejected the motion on Thursday, saying he found the commission had “no relevance to the outcome.”
“It may wish to know who D’s biological father is, but the outcome of its application is irrelevant to it. The desire to uphold the public interest in maintaining accurate birth records does not imply that personal interests determine such an application,” the judge said in the order .
He concluded that the decision rested with the family – whether to undergo a paternity test to tell the child his real father.
