Mi5 After the revelations, the contempt of court proceedings may still face wrong evidence in a bid to secure a C against C. BBC, High court Judges have confirmed.
Possible legal action is accidental on the result of the ongoing investigation.
In 2022, the then Attorney General Sula brevarman Broadcasters went to the High Court to broadcast a program, which would be the name of a person who has allegedly misused two women and is a secret human intelligence source.
An prohibition was later awarded in April 2022, which prevents the BBC from disclosing the information that identifies the “X”. However, Mr. Justice Chamberlain ruled that the corporation may still broadcast the program and its major issues, provided that man is anonymous.
Earlier this year, the London court was informed that a part of the written evidence submitted by the Mi5 in support of their prohibition application was false.
The BBC lawyers told the court to start contempt proceedings against the Mi5 and many persons were met for not being fully transparent with the court.
In a judgment on Wednesday, the Lady Chief Justice Baronic car stated that another investigation should be conducted and that “would be prematurely to come to any conclusion to initiate contempt proceedings against anyone”.
The senior judge said that the new investigation should be done by the Commissioner of Investigation Powers.
Bairness Carr, who is sitting with Dame Victoria Sharp and MR Justice Chamberlane, also said: “Investigations conducted by Mi5 are suffering from serious procedural shortcomings.
“Their findings cannot be trusted in the present.”
After the ruling, MI5 Director General Sir Ken McCallum said: “I want to repeat my complete and unreserved apology for the errors made in these action.
“We take our duty to provide truth, accurate and complete information with extreme seriousness.
“Solving the case to the satisfaction of the court is the top priority for the MI5 and we are committed to the Commissioner’s Office and the court to fully cooperate with the office.”
