A bench of Justices Manoj Mishra and Ujjal Bhuyan sought Shami’s response on his wife’s plea challenging two orders passed by the Calcutta High Court on July 1 and August 25.
The high court has increased the interim maintenance paid by Shami to Rs 1.5 lakh per month for his spouse and Rs 2.5 lakh per month for his daughter, while allowing the cricketer to pay the outstanding amount in eight monthly instalments.
In her petition before the top court, Shami’s wife has argued that the amount awarded is “grossly inadequate” considering the cricketer’s financial condition and “lavish lifestyle”.
He has sought monthly maintenance of Rs 7 lakh for himself and Rs 3 lakh for his daughter.
The plea said Shami’s annual income, as reported in his 2021-22 income tax return, is around Rs 48 crore, while he has been forced to live in “depressed circumstances”, struggling to meet even basic expenses.
It also highlights Shami’s ownership of luxury vehicles, which include a Range Rover, a Jaguar, a Mercedes and a Toyota Fortuner. The couple got married in April 2014.
In 2018, Shami’s wife lodged an FIR at Kolkata’s Jadavpur police station alleging domestic violence, following which a chargesheet was filed against the cricketer.
She later moved the court under the Protection of Women from Domestic Violence Act, seeking interim maintenance.
A trial court had initially awarded Rs 80,000 per month for the child, but refused to grant maintenance to Shami’s wife.
On appeal, the Sessions Court awarded her compensation of Rs 50,000 and the child Rs 80,000 in 2023.
The Calcutta High Court, through its July 1 order, increased the amounts to Rs 1.5 lakh and Rs 2.5 lakh respectively.
In the order dated August 25, Shami was allowed to pay the dues in instalments.
