New Delhi, August 13: The Supreme Court on Thursday heard a petition for the restoration of the state to Jammu and Kashmir.
The matter is likely to listen to the matter due to a back of the Chief Justice Bra Gawai and Vinod Chandran of Justice, because according to the Calist. On December 11, 2023, the Supreme Court unanimously upheld the cancellation of Article 370, even ordered that the assembly elections would be held in Jammu and Kashmir by September 2024 and its state would be “as soon as possible”.
Last year, a petition was filed in the apex court, seeking direction to the Center for the restoration of the state for Jammu and Kashmir within two months.
The application was filed by Zahur Ahmed Bhat, an educationist and a socio-political activist, Khurshed Ahmed Malik.
“It has been presented that the delay in restoration of the state will lead to a serious shortage of democratically elected government in Jammu and Kashmir, which would cause serious violation of the idea of federalism that becomes part of the original structure of the Constitution of India,” the application said.
Assembly elections and Lok Sabha elections were held peacefully without violence, disturbances or any security concerns in Jammu and Kashmir.
“Therefore, there is no obstacle to security concerns, violence or any other disturbances that obstructs or stops the grant/restoration of the state’s status to Jammu and Kashmir, as the current proceedings assured by the Union of India,” said in the petition.
The state of the status of Jammu and Kashmir has been said to be a less form of the democratic government elected to the state, resulting in a low form of the state, especially the results of the Legislative Assembly given were declared on October 8, 2024.
Despite the directions of the top court for the restoration of the state for Jammu and Kashmir, “as soon as possible and as soon as possible”, no step has been taken by the Center to provide any time -timeline for the implementation of such instructions, it has been claimed.
“Jammu and Kashmir are now being operated as a center area for a period of about five years, which has caused many obstacles and serious damage to the development of Jammu and Kashmir and affected the democratic rights of its citizens,” Dalil said.
In its December 2023 judgment, the apex court organized that Article 370, which was included in the Indian Constitution in 1949 to give special status to Jammu and Kashmir, a temporary provision. The President of India was empowered to cancel the measure in the absence of the Constituent Assembly of the erstwhile state, which ended in 1957, the court said. (PTI)
