A federal grand jury today returned an indictment charging former national security adviser John Bolton, 76, of Bethesda, Maryland, with serious crimes related to the misuse of classified information. The indictment charges Bolton with eight counts of dissemination of national defense information (NDI) and 10 counts of unlawful possession of NDI.
Attorney General Pamela Bondy said, “There is a level of justice for all Americans.” “Anyone who abuses a position of power and endangers our national security will be held accountable. No one is above the law.”
FBI Director Kash Patel said, “The FBI’s investigation revealed that John Bolton allegedly transmitted top secret information using personal online accounts and kept the said documents in his home, in direct violation of federal law.” “The case was based on the meticulous work of dedicated career professionals at the FBI who pursued the facts without fear or favor. The weaponization of justice will not be tolerated, and this FBI will stop at nothing to bring to justice anyone who poses a threat to our national security.”
U.S. Attorney for the District of Maryland Kelly O. “Keeping Americans safe has always been and will always be the top priority of the U.S. Attorney’s Office for the District of Maryland,” Hayes said. “If anyone threatens our national security, we are committed to holding them accountable.”

The indictment alleges that Bolton illegally disseminated the NDI by using personal email and messaging application accounts to send sensitive documents classified as Top Secret. These documents revealed intelligence about future attacks, foreign adversaries, and foreign-policy relations.
The indictment also alleges that Bolton illegally kept NDI documents in his home. These documents included information revealing intelligence about an opponent’s leaders as well as sources and collections used to obtain statements on a foreign opponent.
If convicted, the defendant faces a maximum sentence of 10 years in prison for each count of unlawful retention of NDI and a maximum of 10 years in prison for each count of transmission of NDI. A federal district court judge will determine any sentence after considering U.S. sentencing guidelines and other statutory factors.
The FBI Baltimore Field Office is investigating the case.
Assistant U.S. Attorneys Thomas Sullivan and Robert Goldaris for the District of Maryland, Trial Attorneys Adam P. Barry of the National Security Division’s Counterintelligence and Export Control Section, and S. Derek Shugart, and Trial Attorney Tanner Kroger of the National Security Division’s National Security Cyber Section are prosecuting the case.
An indictment is only an allegation. All defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

A federal grand jury on Thursday indicted Trump’s former national security adviser John Bolton on 18 counts of illegally gathering or sending sensitive national security information — leaving the longtime pillar of the Republican foreign policy establishment facing decades in prison.
The indictment in Greenbelt, MD federal court alleges that Bolton sent sensitive national security documents through a personal AOL email account while previously serving in the Trump administration and knowingly transmitted the materials to outside contacts.
Bolton, 76, served as President Trump’s national security adviser from April 2018 until his dismissal in September 2019. Upon leaving office, he pledged that he had no classified documents or notes.
However, those communications — some of which remained on his AOL account — were exposed to bad actors when a foreign entity hacked Bolton’s email, according to a probable cause warrant issued last month.
Bolton faces up to 10 years in prison on each count of the indictment.
Federal agents searched Bolton’s Maryland home and Washington, D.C. office on August 22 in connection with the long-running investigation, which FBI sources told The Post was mysteriously “shut down” during the administration of President Trump’s predecessor, Joe Biden.
