Srinagar: J&K Lieutenant Governor Manoj Sinha has returned the file related to the proposed J&K transaction of the Professional Rules (TBR) sent by the Omar Abdullah government in early March for his approval, asking whether the necessary procedures were followed while stalking the rules.
Sources said that the file was sent back a few days ago, about two months later, it was first presented for the approval of LG after clearance by J&K cabinet.
The TBR, which wants to offer clarity, would work in J&K in the secretariat and other government offices, senior advocate Rohinton Nariman by a high -level committee.
A senior official said the file was refunded as TBR was found to be contrary to the provisions of the J&C Act by the LG’s office.
TBR proposes that all posting and transfer, including IAS officers, should be approved by the J&K Cabinet. However, Section 53 of the J&K Reorganization Act clearly states that LG, in the practice of its actions, will work in its discretion in matters related to all India services and anti -corruption bureau, besides cases which come out of the powers of the Legislative Assembly or are related to the practice of any judicial work.
The TBR claims the powers associated with the state even without the state. An official said, “The provisions of the restructuring act of J&C have been misinterpreted … No rules can be beyond the word written in an Act of Parliament,” an officer said.
The Abdullah government has been complained about posting of IAS officers at the top of several government departments in Jammu and Kashmir, which was previously occupied for Jammu and Kashmir Administrative Service (JKAS) officials. Only on 29 April, the Abdullah government issued transfer orders of 96 JKAS officers.
