In a medical follow-up evaluation after the ship docked, the girl was reported to have mild hypothermia and mild lactic acidosis, which occurs when lactic acid builds up in your blood when your tissues lack oxygen. But her father had two spinal fractures, as well as lactic acidosis and hypothermia.

The mother told police that she had taken several photographs in front of several other windows and portholes during her visit, and “initially she assumed that this porthole, like many other portholes seen throughout the ship, was equipped with a window or plexi-glass barrier,” the memo read.
According to the memo, police observed several large open windows on deck 4 that “did not have any material protection”.
Kelly said he declined to charge the mother with child neglect without causing physical harm because she was “innocently” taking photographs of her daughter, believing there was “some kind of protective barrier between the railing and the water.”
“This was an isolated incident and all evidence suggests it was purely accidental,” Kelly said.

The prosecutor also said that the mother was supervising her daughter, and that the girl “was not injured.”
Kelly said, “Although the defendant’s conduct is arguably reckless and irresponsible, it does not reach the serious level of conduct required to establish criminal negligence.”
