New Delhi, Oct 14 (IANS) Law and Justice Ministry Secretary (Legislative Department) Rajeev Mani called for a change in the philosophy, approach and mindset of people to explore other methods of dispute resolution like arbitration, an official said on Tuesday. Speaking at the valedictory session of the first batch of the Indian Institute of Corporate Affairs (IICA) Certified Arbitration Program (ICAP), Mani stressed the importance of arbitration as a method of dispute resolution, apart from traditional court litigation. He mentioned lesser known facts about the preference given to arbitration by the Constitution makers in certain cases during the transitional period of Indian constitutional history. The valedictory session of the first batch was held on 12th October at IICA campus, Manesar. The event was organized by the Center of Excellence in Alternative Dispute Resolution (CEADR) of the Indian Institute of Corporate Affairs, Ministry of Corporate Affairs. The objective of the program is to create a pool of the next generation of global arbitration professionals. Earlier, former Law Secretary PK Malhotra in his address acknowledged the caliber and immense potential of arbitration professionals in India; However, he raised concerns over the lack of a supporting ecosystem. He also stressed the importance of establishing the Indian Arbitration Council with such changes as may be necessary for its effective functioning. The two-day campus immersion and valedictory session was inaugurated by Justice Hemant Gupta, Chairman, IIAC, on October 11. In his keynote address, Justice Gupta appreciated the efforts of IICA in contributing to strengthening the arbitration ecosystem in India. Furthermore, in view of India’s economic growth, Justice Gupta stressed the need to create a strong alternative dispute resolution system to boost investor confidence. He also stressed the need for institutionalized arbitration to ensure structured and effective conduct of arbitration proceedings in India. Gyaneshwar Kumar Singh, Director General and CEO, IICA, briefed about various studies conducted in arbitration and highlighted the need to standardize the arbitration landscape through institutional arbitration in India. They also discussed issues related to the enforceability of arbitral awards along with ways to mitigate such issues. –IANS rch/dan
