The co-founder of Palestine Action can press ahead with a High Court challenge against the government over banning the group as a terrorist organisation, the Court of Appeal has ruled, as it rejected a Home Office appeal.
In summarizing the Court of Appeal decision dismissing the Home Office appeal, Lady Chief Justice Baroness Carr said: “An application to set aside, with a right of appeal to POAC (Proscribed Organizations Appeal Commission), was not intended to be a means of challenging the initial decision.”
He added: “Judicial review would be a faster means of challenging an order banning Palestine action than applying for de jure.
“Judicial review will enable the High Court to give an authoritative judgment on whether banning Palestine Action is lawful. That judgment can be relied upon in criminal courts to hear charges against any person arrested in connection with support of Palestine Action.”
