In addition, Jensen, a specially trained drug recognition evaluator, was called in to assess whether Bimpong was under the influence of drugs, or suffering from a medical emergency.

The lawsuit alleges that Jensen did not complete his evaluation properly or completely, and allowed Bimpong to be taken to the Eagan police station instead of receiving medical treatment. He was arrested for DWI.

Bodycam audio allegedly captured Jensen saying that the entire DRE examination, approximately 30 to 45 minutes, would be “a lot of time wasted”, and when another officer asked if Bimpong should be taken to the hospital, he responded “For what?”

He was later taken to the Dakota County Jail and placed in a holding cell where he collapsed, urinated on himself and writhed around on the floor. Despite guards repeatedly passing by the cell for more than three hours, no intervention was taken.

“Kingsley was at death’s door when prison and medical staff entered his cell,” the lawsuit states. Bimpong was found “with the pallor of a corpse”, and when he was finally taken to hospital medical intervention failed.

He was later declared brain dead at United Hospital due to “intracerebral hemorrhage of the left cerebral hemisphere” – also known as hemorrhagic stroke. His family members, some of whom live in Ghana, eventually decided to remove him from life support and Bimpong died on 19 November.

“For Kingsley, each minute of deliberate indifference over the course of 5 hours and 40 minutes increased and resulted in his death,” the lawsuit said.

“Regardless of the underlying cause of Kingsley’s severe medical needs, each individually named defendant observed that Kingsley was exhibiting clear and severe physical and cognitive abnormalities that required immediate medical attention.”

Independent The Eagan Police Department and the Dakota County Jail have been contacted for comment on the lawsuit.
