A bench of Justices JK Maheshwari and NV Anjaria questioned why two benches of the Madras High Court passed different orders on the same incident, with one (Madurai bench) rejecting the plea for a CBI probe and the other (Principal Bench) directing a SIT investigation. The judges also expressed concern that the high court order went beyond the relief sought, which was limited to formulating a standard operating procedure (SOP) for political rallies.
Justice Maheshwari commented, “What troubles us is that the prayer was made for permission to hold a meeting, but the High Court saw something else and ordered an SIT investigation. We should limit it somewhere.”
TVK has sought a stay on the High Court order, removal of adverse comments against its leaders and appointment of a former Supreme Court judge to oversee the investigation. The court directed the parties to file their counter affidavits before reserving its order.
