The government on Thursday, October 23, sent a letter to CJI Gavai recommending his successor for the top post of the judicial system, news agency PTI quoted sources as saying.
However, the letter may be delivered by the evening of October 23 or on Friday, October 24.
Current Chief Justice Gavai will retire on November 23 after attaining the age of 65 years.
According to the memorandum on the procedure for appointment of judges, the senior-most judge should become the CJI and assume the top judicial office.
According to PTI, the Union Law Minister traditionally seeks the recommendation of the retiring CJI for the appointment of a successor.
If Justice Surya Kant takes up the role of CJI, he will hold the post for about 15 months and will retire on February 9, 2027.
CJI Gavai serves as the 52nd Chief Justice of India and took charge on May 14, succeeding former CJI Sanjiv Khanna.
