Judges should not praise politicians and bureaucrats… said Supreme Court Justice Justice Bhushan Ramakrishna Gavai. Addressing the annual conference of Gujarat judicial officers, he said judges’ praise of politicians and bureaucrats affects public confidence in the judiciary.

Justice Gawai said the conduct of judges, whether on or off the bench, should be consistent with the highest standards of judicial ethics. If a judge goes beyond protocol to praise any leader or bureaucrat while in office, it may affect public confidence in the judiciary.

Justice BR Gavai also gave an example to explain his point correctly. He said a U.S. Supreme Court justice must apologize for comments critical of a presidential candidate. Among other things, he said if a judge resigns to run for office, it could affect the public’s perception of his or her impartiality.

He further said that comments made by judges outside the scope of specific cases, especially those involving sensitive topics such as gender, religion, caste and politics, deserve attention. He said people can seek justice through methods such as mob justice. This has caused great harm to social security. Not only that, people are hesitant to file a case and knock on the court’s door. Lengthy litigation and slow court proceedings have left people disillusioned with the justice system, he said. Delays in delivering justice also make a fair trial very difficult.

In his speech, Justice Gawai praised the live broadcast. He said the courts were now significantly more transparent thanks to video conferencing and live streaming of the Constitutional Court.
