Woman argues she still feels pain while competing
An Irish court has dismissed Kamila Grabska’s $820,000 injury claim after a photo showed the woman throwing a 5ft spruce tree at a charity event in January 2018 .
Ms Grabska, 36, is suing an insurance company, claiming she suffered persistent neck and back pain as a result of a crash on February 3, 2017. protector reported.
The mother-of-two said the injuries she suffered in the crash had hampered her ability to work, be active with her children and do basic household chores for more than five years.
However, at a recent hearing a photo from a national newspaper was shown showing Mrs Grabska appearing to take part in a Christmas tree throwing competition on January 8, 2018, which she ultimately won.
Judge Carmel Stewart dismissed the case based on this inconsistency. The judge said the “very graphic images” played a role in her decision. “It was a very large natural Christmas tree and she threw it with great agility,” she said, according to the Irish Independent, according to The Guardian.
“I’m afraid I can only conclude that these claims are entirely exaggerated,” the judge added. “On that basis I recommend that this charge be dismissed.”
The woman argued that she was still in pain while competing, SWNS reported. She also said she quit her job after the accident and later received a disability certificate.
Grabska calculated her past and projected lost earnings as a result of her injuries to be approximately $541,615.
She dismissed accusations of faking her injuries, insisting she was just “trying to live a normal life”, the Irish Independent and The Guardian reported.
Additionally, in addition to photos of Grabska participating in a tree-throwing contest, a video was shown in court showing the woman training her dog outdoors for more than an hour in November 2023.
