Bangalore, September 30 (IANS) objected to the petition filed by the jailed actor Darshan about the jail facilities, Special Public Prosecutor (SPP) Prasanna Kumar presented in the court on Tuesday that the jail officer Darshan cannot be provided a luxury bed inside the jail.
After a statement of darshan in the court on 25 September, the jail officials have failed to provide facilities even after the court order, the 57th session court called the Superintendent of the Bengaluru Central Jail. Argument and counter -protests are progressing in the court on the petition of philosophy.
SPP Prasanna Kumar presented documents giving details of facilities provided to the philosophy as per the court order and the jail manual. Constantly opposing this, the advocate of philosophy Sunil argued that his client had not demanded a Golden Khat. “He has given him only a tambler, a glass and a mat. The jail authorities have not understood the court’s instructions,” he said.
Sunil told the court, “The officials have thrown the court order. It seems that they are unable to understand the English language.”
SPP Prasanna Kumar objected to the remarks, saying that it was unfair to argue that the officials do not consider English. He said, “Arguments should be made keeping in mind the decoration and dignity of the court.” The court then asked Advocate Sunil to adopt a soft voice and especially to explain which order was not obeyed instead of making a normal allegation.
Advocate Sunil further said, “Carpets and blankets were provided earlier. A thick blanket was given only after a court order. Darshan is allowed to walk inside the barrack for 30 minutes, but is not allowed to go out.”
He also objected to the maintenance of a separate register for the visitors of Darshan. However, the court noticed that the jail authorities should ensure the safety of the accused persons, and for this reason they can take appropriate measures. “The court will not interfere in law and order cases, as it is the responsibility of the police to maintain law and order,” it was underlined.
Sunil further argued that philosophy was being placed in a quarantine cell, although no other prisoners were limited in this way. “Darshan is kept in the same type of cell which is reserved for terrorists. The officials claim that these steps are being taken only because he is a celebrity,” he said.
At this stage, SPP Prasanna Kumar commented, “If they ask for a golden cot, it cannot be provided.” Advocate Sunil said that his client had never made such a demand. He also said that the jail manual of the central government is not being followed. “It clearly specifies that prisoners should be given proper food, bed, fresh air and water. This also includes provisions about the placement of prisoners within the premises. The prison prisoners must have some connection with the outside world,” Sunil argued.
“When the court orders are not followed, it is painful. The guilty rapist Umesh Reddy has been given a color television facility, yet Darshan has not been given any such facility. Why can not the philosophy be given to the facilities that have already expanded a rapist?” Sunil questioned his client’s treatment, alleging prejudice.
Sunil said, “The SPP should stand in favor of justice. The Supreme Court has said that it cannot live only with the police.”
SPP Prasanna Kumar objected to these comments, saying, the advocate asked to specify which facilities were denied and who should be provided. Defending the decision to put Darshan in a quarantine cell, he said that the word “quarrel” appears 11 times in the rule book. In response, Sunil challenged that if the Rules Book actually included the word, he will withdraw his application.
SPP Prasanna Kumar said that there is a provision to keep Darshan in a quarantine cell, as it is part of the jail. “He can be placed anywhere inside the jail. Measures taken for the jail administration are favorable. Darshan is an undertier prisoner. According to the rules of Karnataka Jail, there are two categories of prisoners: special and general. Each prisoner is allocated to the cells, based on the safety risks of each prisoner,” he said.
The fans of Darshan, Renukaswamy, took place on 8 June in Bengaluru. Renukaswamy was kidnapped from his hometown, Chitradurg, who was brought to Bengaluru, placed in a shed, and killed.
After the murder, his body was thrown into a canal. The body was seen dragging by a packet of dogs by security personnel of a private apartment building.
The police had presented 3,991-Page Chargesheet, his partner Pavithra Gowda and 15 others in the court against Darshan in the court. The Supreme Court recently canceled its bail and reprimanded the jail authorities, to ensure that no facility has been provided to darshan in violation of the rules.
