The prosecution’s complaint was filed before a special Prevention of Money Laundering Act (PMLA) court in Gurugram, Haryana on October 13.
The court has not yet taken cognizance of the charge sheet.
Yadav (28), Fazilpuriya (35), a company named Sky Digital India Private Limited. The limited and its director Gurkaran Singh Dhaliwal have been named as accused in the charge sheet, sources told PTI.
Yadav has been charged with generating, acquiring and possessing proceeds of crime
84,000 from the monetization of an “offending” video uploaded in 2023, which depicted live snakes and an iguana (a protected species of lizard).
Fazilpuriya has been charged for the same offense as during investigation it was found that he was the producer and owner of a music video titled ’32 BORE’ which used protected wildlife species (snakes and an iguana) in violation of Section 51 of the Wildlife Protection Act.
The agency has alleged that Elvish Yadav and Fazilpuria “illegally used protected species of exotic animals like snakes, iguanas in the production of commercial music videos and vlogs for the purpose of increasing followers and earning money.” “These music videos were given to Sky Digital India Private Limited and the videos were then uploaded to YouTube to generate revenue,” it said.
Both Elvish and Fazilpuria have been questioned by the federal agency at its regional Lucknow office. The central agency had registered a case in May and laid charges under the PMLA after taking cognizance of two police FIRs and a charge sheet filed against Elvish and persons linked to him by the Gautam Buddh Nagar (Noida) district police in Uttar Pradesh and another by the Gurugram police. Elvish was earlier certified by Noida Police.
The controversial YouTuber, who is also the winner of the reality show Bigg Boss OTT 2, was booked by the police under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, Wildlife Protection Act and various sections of the Indian Penal Code (IPC).
