ECI issues notification for biennial elections for 4 Rajya Sabha seats from J&K

Srinagar, 24 September (IANS) Election Commission of India (ECI) on Wednesday announced the program for biennial elections from Jammu and Kashmir (J&K) for 4 vacant seats for Rajya Sabha.

The Rajya Sabha elections could not be held in J&K in February 2021 as the central region was under the President’s rule and the assembly was dissolved.

The ECI notification issued today said, “The tenure of the post of 4 members of the Council (Rajya Sabha) of the states elected from the erstwhile states of Jammu and Kashmir has ended at their retirement.

“The then state of Jammu and Kashmir has been bifted in the center areas of Jammu and Kashmir (with Aizylcher) and Ladakh (without the Legislature).

“Jammu and Kashmir Reformation Act, 2019: According to Section 9 of the said Act, 4 sitting members of the states representing the existing states of Jammu and Kashmir were selected to fill the seats allotted in the center region of Jammu and Kashmir, as specified in the first schedule.

“All 4 seats have been lying vacant since the end of the period of the office of the members sitting due to the non-availability of the voters required to conduct the said elections at the time of the above vacancies.

“As a result of the constitution of the State Legislative Assembly of UT of Jammu and Kashmir, voters are required to conduct biennial elections from UT of Jammu and Kashmir to the Council of States from UT. Candidates of 6 October 2025 (Thursday) were returned from October 24, 2025 (Friday) before 5 October 2025 (Friday).

“These 4 vacancies are being held as per the law, in the subject, each of these 4 vacancies fell under 3 different cycles.”

“In this context, it has been said that the Commission’s decision to hold a separate election in the Hon’ble Delhi High Court in the Hon’ble Delhi High Court in the Civil Rit Petition No.132 of the Civil Rit Petition No.132 of 1994 was questioned by the Indian National Congress, saying that all 3 vacancies can be selected as a general election, which are holding a general election for elections.

“The Hon’ble Delhi High Court, however, as per its order on 14 January 1994, dismissed the petition, holding, inter alia, as follows: ‘We see that the seats have been divided into 3 categories once, which were right to the responsibilities to hold separate elections for each category.’ Now these 3 seats come in 3 different categories, so the elections of these 3 seats will also have to be separated.

“According to the law, the aforesaid 4 seats, already vacant in the Rajya Sabha on 102.2021 and 15.02.2021, from UT in Jammu and Kashmir, three separate biennial elections will also be filled.

“Further, the tenure of the post of members selected from UT of Jammu and Kashmir to the council of states will be subject to the Honorable Supreme Court’s decision.

“The Commission has directed that the integrated violet color sketch pen (s) of the pre-determined specification of the pre-determined specification will be used,” the Commission has directed that it will be used.
