Sam Jones defended and said: “This case on the facts is a sad matter in any scene.

“This is a sad matter not at least because those who have participated in support of the defendant today are those who have been so impressed by the result of the alleged incident.

“Both the defendant and his brother were drunk at the relevant time.

“One of the eyewitnesses of the incident, the father of the defendant, Lee’s statement in his witness of his witness after hitting his brother on two occasions and after both of them ended on the ground, after stopping the defendant, after stopping his brother, after which he separates, he kills Lee Direct and kills the direct direction.

“In his own interview with the police, the defendant has described the kick and punch with him.

“But it is accepted on their behalf that the only proof of connecting those wars comes from them.

“The witnesses at the scene directed a kick and a punch to him, but do not join him.

“The basis of the argument on behalf of the defendant is that after separating the two and after the attempt of Kick and Panch, the defendant then accepts in the context that throws the single punch he had done, causing injury.”

Mr. Jones said that medical experts were not able to determine the level of force when the defendant punched his brother.

He said, “Medical professionals are not able to indicate the level of used force, but that Panch hurt Lee’s jaw, not enough force to cause any fracturing,” he said.

“A punch of medium force, possibly a minor force, could cause a reaction to Lee’s head in response to punch, which then triggered a deadly injury.”

Robin Shellard, the prosecution said the petition convicted for the murder was acceptable.

“We certainly accept that it was a fight between the two brothers,” he said.

“Lee definitely called his brother out, he was wrestling on the floor and was exploded by Lee towards Ben and vice versa.

“Two independent witnesses say the fight was over from that stage, so there was no self -defense.

“It was in the context that it was out of anger or really another reason, but certainly not self -defense.”
