The lawsuit sought a permanent injunction, damages, rendering of accounts and ancillary relief for trademark infringement, passing off and unfair competition.
Claims were made that the defendants contacted members of the public via phone and email, falsely identifying themselves as agents or employees of the company and offering job opportunities.
It further alleged that the defendants requested payment of ‘processing fee’ under the false pretext of recruitment.
To deceive job seekers, the defendants were also using Akasa Air’s registered trademarks, such as ‘Akasa’ and ‘Akasa Air’, as well as confusingly similar marks and registered infringing domain names, including ‘Akasa’ and ‘Akasa’.
The court determined that the prima facie case was in favor of SNV Aviation (Akasa Air) The Bar and Bench reported on the basis of the evidence presented.
“The Court, after considering the materials on record, holds that a prima facie case is made out in favor of the plaintiffs (SNV Aviation/Akasaa Air). The acts of the infringing defendants in contacting unsuspecting members of the public, misrepresenting that they are offering employment on behalf of the plaintiffs, and demanding ‘processing fees’ for such employment, while the plaintiffs have admitted that there is no such practice, clearly Misrepresentation amounts to fraud and misrepresentation.” Said.
It added, “An injunction is also necessary to protect the interests of the general public, which have been implicated by the infringing defendants. Accordingly, this court finds it appropriate and necessary to grant an injunction to restrain the defendants from continuing such fraudulent activities.”
On December 22, the court barred several entities from using the airline’s trademark or any similar or confusingly similar mark in any way. It directed to suspend and lock specified domain names, disclose KYC details and block mobile numbers belonging to alleged impersonators and block specified UPI IDs and bank accounts.
The matter has been scheduled for hearing before the joint registrar on February 3, 2026, and before the court on May 22, 2026.
