Delhi High Court stops manufacturer from infringing Britannia’s ‘Little Hearts’ mark

The Delhi High Court has restrained a manufacturer and others from infringing the trademark and shape of Britannia’s ‘Little Hearts’ biscuits.

Justice Manmeet was hearing a case filed by Pritam Singh Arora Britannia Industries Limited It was claimed that Shree Swastik Organics and others were not only using its trademarks but also using a similar 3D shape to sell biscuits online.

In an interim order dated December 23, the court said, “This is a case of triple identity where the marks are almost identical, the products are identical, and the trade channel, as well as the consumer base is also identical.” The court held that the plaintiff (Britannia), being the former user, adopter and registered proprietor of the ‘Little Hearts’ trademark or shape, is entitled to protection.

The court said, “The plaintiff has made out a prima facie case for grant of injunction against the defendants (Shri Swastik Organics and others). This court is satisfied that if interim injunction is not granted at this stage, the plaintiff will suffer irreparable loss/injury.”

It restrained the defendant company and its partners from using, manufacturing and selling goods bearing Britannia’s trademark or any confusingly similar mark.

The court also ordered the e-commerce platform to remove or remove from the list all products bearing the infringing mark or shape.

It listed the matter for further hearing on May 21, 2026.
