Delhi High Court rejects Deepika Padukone’s plea

LOTUS reportedly sent 82e a notice to stop using the name “Lotus Splash,” and it subsequently filed suit seeking a permanent injunction banning its use. Senior advocate Akhil Sibal, representing LOTUS, reportedly said that discussions in 2021 for defendant 2 to become the plaintiff’s attorney did not materialize.

Sibal further claims that 82e initially made misrepresentations that they had not filed any trademark applications for their products “Patchouli Glow,” “Turmeric Shield,” and “Licorice Beam.” When it was brought to court, they called it a “lawyer’s mistake.” NDTV reported that 82e argued that they were not seeking registration of the “Lotus Splash” trademark but were using the “lotus” in “Lotus Splash” as a description. Sibal argued that the defendants’ use of “Lotus Splash” as a descriptive was inconsistent with the actual trademark application they filed.
