Delhi HC demanded Rajasthan Police Report on alleged illegal arrest of two minors from Janakpuri

New Delhi, 30 September (IANS) Delhi High Court on Tuesday directed the Rajasthan Police to submit a detailed status report in the alleged illegal arrest and custody of two minor boys of Delhi in Delhi.

A bench of Jyotis Jyoti Singh and Aneesh Dayal was listening to a prisoner corpus petition filed by Street Hawker Kapuri Bai, who alleged that her son, 15 and a relative’s son, 17, on September 26, was forcibly taken from unknown men in civilian clothes from Dussehra Park in Janakpuri.

According to the writ petition, despite repeated efforts, his families were unable to complain of a missing persons at Janakpuri or Hari Nagar police stations in Delhi.

The hideouts of the boys later surfaced through a phone call, stating that they were being held at Pushkar police station in Rajasthan.

Pushkar Shu later informed that the two were arrested on 29 September in connection with an alleged robbery. He further stated that his mothers were duly informed about the arrest.

In its order, the Delhi High Court mentioned a serious process violation after the petitioner’s counsel, stating that “no security measures/protocols were followed”.

Confirming the lapse, the Delhi government’s permanent lawyer (criminal) Sanjay Lao said that the two minors were not informed to the local police before taking them to Pushkar “and” Sandeep Kumar vs. has violated the guidelines set by this court in the state “.

PS Pushkar Inspector Vikram Singh Rathore virtually appeared, presented that no age was verified so far, although medical examination started.

He further admitted that when the bench led by Justice Singh asked whether the local police (ie Delhi Police) was not informed before the investigation or before the arrest, there was no answer.

Given the sensitivity of the case, especially since the family members belong to Dev Pardi, who died in alleged custody in July, the Delhi High Court ordered that a comprehensive report should be filed under the signature of Superintendent of Police, Ajmer.

“We are of the idea that a wide status report needs to be filed by the permanent lawyer, Rajasthan state … given that S and petitioner are relatives of Dev Pawdi, it is directed that the status report will be filed under the signature of Ms. Vandita Rana, SP, Ajmer, Ajmer, Rajasthan.”

The Delhi High Court directed Inspector Rathore to keep Hari Nagar Shu updated on the incident incident during the day.

The case will be raised again at 10.30 am on Wednesday
