Delhi Court fines Rs 30,000 on accused for avoiding physical presence

New Delhi:

Delhi’s Rohini court recently imposed a fine of Rs 30,000 on an accused for avoiding physical appearance.

Despite instructions from the High Court to appear and apologize, the accused did not appear in the lower court.

Metropolitan Magistrate Divya Arora imposed the fine on accused Sanjeev Chadha and directed him to pay it at DLSA North West.

“It appears that accused Sanjeev Chadha has a habit of avoiding his appearance under one pretext or the other. This can be seen from the court file,” the court said.

The court said that the accused is misusing the process of law by appearing through the VC. “Considering the conduct of accused Sanjeev Chaddha, a fine of Rs 30,000 has been imposed on him, which will be paid at DLSA North-West,” the court said.

The court also said that on 12.13.2023, the Delhi High Court had directed the accused Sanjeev Chadha to appear before this court and tender an unconditional apology.

The judge said on Monday that even today accused Sanjeev Chaddha appeared through the VC.

The case pertains to an FIR lodged at Keshav Puram police station under section related to fraud in 2019 and following this, Delhi Police had filed a charge sheet against two accused, including Sanjeev Chadha.

On December 13, 2023, the High Court had passed the order in view of an undertaking given by the learned counsel for the petitioner that he would appear before the learned Trial Court as there is no stay on the proceedings. The petitioner will unconditionally apologize to the learned trial court for the inconvenience caused and the learned trial court will proceed with the matter. The court had said.
