CBI court sentenced two to 5 years for fraud insurance claim

New Delhi, 23 September (IANS) A special CBI court in Ahmedabad on Tuesday convicted two people in a case of almost two-opinion-old fraudulent fire insurance claims, in which they were sentenced with five years rigorous imprisonment (RI) as well as a cumulative fine of Rs 60 lakhs.

Special Judge for CBI cases Rashik J. Patel Dalsania, M/S Meera Partner, and Sanjay Ramesh Chitre, M/SR Chitre & Company owner, were found guilty for the use of criminal conspiracy, cheating, forgery and fake documents. Dhansania was fined Rs 45 lakh, while Chitre was fined Rs 15 lakh.

The case returned on January 20, 2002, when a fire broke out in the factory of Mira Chemicals in Gidc, Panoli, Bharuch.

After this incident, the company claimed with United India Insurance Company Limited (UIICL). Chitre appointed as the surveyor assessed the damage of Rs 36.92 lakh. The claim was later approved by the UIICL authorities, and Rs 36.86 lakh was paid.

However, an investigation by the CBI’s Gandhinagar unit registered in June 2006 revealed that fake documents, including fake bills and vouchers, were presented to protect exaggerated losses and safe inappropriate financial benefits.

The CBI said, “After investigation and recommendations, including branch and divisional offices from UIICL officials, the claim was approved, and paid. However, the investigation revealed that it was discovered that fake bills including fake bills and vouchers were presented to damage and restore forged documents.

After investigation, two separate charge sheets were filed – one against Dalsania and Chitre, and another UIICL officials, including the then divisional and regional managers. The allegations included criminal conspiracy, forgery for valuable security, use of fake documents and criminal misconduct.

During the trial, 34 prosecution witnesses were investigated and 234 documents/demonstrations were trusted in support of the allegations against the accused. The court qualified and convicted and convicted them.

The court gained enough qualification to convict Dalsania and Chitre but acquitted all public servants of UIICL allegations.

One of the accused, retired manager Cherucchco Gopalan, died during the test, causing the allegations against him.
