A multi -daughter -in -law who makes 19 children a father -” Desire fight.

Richard Scott – who died at the age of 81 in 2018 – made a fortune to run the second largest boot fair in the UK with his “huge”, Cheshire Farm where ITV‘Car Boot Challenge’ was filmed.

Mr. Scott’s eldest son and “favorite” Adam Scott -was described as his father’s “Golden Boy” -he says he sacrificed his life to work on the farm -whey -bay -road with his father from the age of nine, and promised that all this would be his day.

But after Adam’s mother’s death, Richard revived from his former cleaner Jennifer Scott in 2016 – who was 28 years old and younger than his son – and then wrote Adam out of his willpower, left Jennifer in his property and farm control, which he says that he can now be worth £ 43m.

Now 62-year-old Adam is sueing his stepmother as the executive of Adam Richard’s property, claiming that his father was not in his right mind when he signed his two final will.

He also says that his father promised him that he would have the right to handle the farm after his death and he sacrificed everything to be committed to “the life of difficult and incredible physical works” behind those promises.

But Jennifer’s lawyers claim that Richard knew what he really was doing when he “completely broke the relationship with his father after his first birth” broke “when he tried to take a stream to Richard.

He also says that he has no claim of his father’s property based on alleged promises, which was already assigned land and property of more than £ 10m before Richard’s death.

The High Court of London heard that the “Mercury character” Richard “was a ruthless, single-minded and highly successful businessman who created a valuable property empire before running the huge and attractive car boot sales.

He gave birth to a surprising 19 children, Jennifer’s lawyers told the court, six with his first wife, as well as six illegitimate children during that relationship, followed by another seven with Jennifer, who was working as their cleaner when the pair was first together in 1994.

For Jennifer, Alex Troop Casey told Mr. Justice Richards, “It is common that Adam attended the Registry Office on 22 April 2016 and alleged that Richard had a lack of ability to get married.”

“Due to this, Richard was interviewed by four registrars and a local council lawyer, all of whom were satisfied that they had the ability to get married. The marriage moved forward.”

By the time he died of cancer, Richard had a “large amount of land” around Chelford, Cheshire, which is officially considered valuable for probate at about £ 7m, but Jennifer claims that she is £ 43m based on the price of 43 meters which she has received and has the ability to grow.

Adam’s lawyers say that he spent more than 40 years to help his father to help run a “huge, huge” farm and manage the sale of car boots, and on this basis it was queuing to inherit it that he would pay the probate value of the land, then the cash should be divided between the cash with that cash.

But in 2016, a few months after his second marriage, Richard signed two Wils, disintegrating Adam and left Jennifer under his control PropertyAs an executive and a major beneficiary.

Jennifer’s two sons, Gordon and William Redgrav-Skot, and Adam’s sister Rebecca Horley were also made the beneficiaries of the final will.

Adam is now challenging the validity of those two final will on the basis that his father lacked mental capacity when he was created.

He is also bringing an alternative claim under the ownership Estopel’s law – a legal measure that can be used when a landlord has promised that the property will be transferred to someone else at a later date – only later to the promise.

Constance McDonal Casey, for Adam, told the judge, “The case has a connection between a father and a son, his shared devotion to the family farm in the Cheshire, and a recognition by his son’s father’s father’s will is committed to a hard and incredible physical work.

“This case is a paradigm example of a dedicated child’s claim to a farm, which is in accordance with the legacy of the parents.

“Adam wants a solution equal to the provision made by his father Richard to him on 23 June 1995, which implemented the promises made to Adam.

“On those terms, Adam will get a 40 -year tenancy of his father’s farm and the option to buy the farm at his probate price.

“It was not surprising to any witness that Richard promised Adam that he would be able to cultivate farm from succession, and that Adam made an extraordinary sacrifice by dedicating himself to the farm, and doing extraordinary sacrifices in doing so, loss of his marriage and family holidays with his children and other time.

“Adam’s work enabled the farm to generate a profit, which Richard enjoyed the profit and who enabled him to discharge his own expenses, including Jennifer as well as private school fees for his children, as well as able to invest in the field again.

“This allowed the farm to function smoothly and with the minimum labor cost despite Richard’s ongoing health problems, which began in early 1976.”

He said that the evidence supporting Adam’s claim about promises is “very broad” and the judge would need to decide if his father is going back to him “unconscious”.

“In the case like the present, where decades of work and life -changing decisions are made in dependence on a promise, the discretion of the court should be surprised,” he said.

Turning to Richard’s mental state, when he created 2016 Wills, Barrister said Richard was diagnosed as dementia in 2011 and was able to communicate until the time he was signed when he was signed.

“Richard’s medical records include clear evidence of his ability to decide and insight has been erased by his dementia,” he said.

“Adam said Wils of September and December 2016 could not have any guess in favor of his father’s knowledge and approval. By this time, his dementia had left him unable to speak more than a timely word.

“He demanded to communicate in writing and gestures, but could not write more than some words or numbers. Jennifer worked as Richard’s ‘translator’,” to explain what he intends to others.

“Richard died seven years ago. Since that time, the parties have been closed in war and despite the timely termination of enmity, no peace has been achieved.

“Nothing beyond Richard’s plan in 1995 can be that Adam – his ‘Golden Boy’ – will proceed with the venture of farming, in which both of them were dedicated, and that their other children would either be provided for rental income or a lump sum payment in the property in exchange for the farm.

Mr. Troop, who represented Jennifer, however, told the judge that Richard had good reasons for cutting Adam.

He said, in September 2013, Richard’s GP, a psychiatrist, police and two nurses visited the pear tree farm with a scene to participate under the Mental Health Act 1983.

“But when he met Richard, he considered that he had capacity and so did not block him,” he said.

“Freedom of requesting information by Jennifer revealed that the journey was inspired by Adam, who represented social services that Richard had lost its capacity.

“In July 2015, Adam accused social services that Richard Jennifer and children were beating. This led to an investigation by social services, which was eventually closed, but children were placed on a security register, which they had harassed.

“On 22 April 2016, Adam attended the Registry Office and alleged that Richard had a lack of ability to get married. This led to Richard interviewed by four registrars and a local council lawyer, all of whom were satisfied that they had the ability to get married. The marriage moved forward.

“Richard was a small -tempered, a totalitarian father who expected his children to work hard on the farm and would not make any dissatisfaction. They are described by their children as ‘controlled, manipulative and unexpected’ by their children ….. He was able to fall out with her children.”

In connection with the claim of ownership Estopel, Barrister told the judge that Adam was already assigned land and property of more than £ 10m by his father before he died.

“It is clear that Richard wanted his children to be benefited by the fruits of his laborers, and in this regard, he treated Jennifer’s children at a uniform rung with his first marriage children,” he said.

“Adam worked on the farm for his father, and in later years he did so to a greater extent than his brothers, but he knew about Richard’s mercury character.

“He knew that Richard had five other children from his first marriage, and seven children by Jennifer, all of whom hoped for heritage.

“Adam was rewarded for his work, in which Richard gifted gifts from a lifetime for adequate parcels, which have proved to be extremely valuable.

“Adam depends on many alleged statements made by Richard as an assurance. Adam did not have sufficiently clear statements in any statement made by Richard in the early years, which was to be taken seriously. Adam said that ‘When I was younger, it was just an hope …’

“Richard was a naturally incredible character, whose track records were of breaking promises,” the barrister concluded.

The test is going on.
