Canada’s federal polling system is constitutional, Ontario Court of Appeal Rules

Ottawa-Ontario Court of Appeal has confirmed the constitutionality of the electoral system in the first place of Canada.

The system placed in the Canada Election Act sees the candidate, who gets the most votes in a given ride or electoral district, becomes a member of Parliament.

Fair Voting BC and SpringTide Collective for Democratic Society argued that the first-pass-post-post voting system violates the guarantee of the effective representation of the Charter of Rights and Freedom.

Groups also said that the system leads to the underpraggentation of women and other groups in Parliament, which dissolves the provision of equality rights of the charter.

Under a proportional representation system, the number of representatives of a party elects reflects the percentage of the total vote received by the party.

In November 2023, the Ontario Superior Court rejected the challenge of the groups, stating that a proportional representation system would be currently a proper option, it is not necessary by the Constitution.
