Kolkata, September 19 (IANS) A Division Bench of the Calcutta High Court on Friday, retained the previous order of a single-judge bench of the same court, emphasizing the need for detailed hearing on the merit and eligibility of Kajori Benerjee, which is the sister of the sister-in-law of West Bengal, who is the sister of an executive committee.
On 17 September, the single-judge bench of the Calcutta High Court Justice Baiwas Pattanayak questioned how, despite not being an educationist himself, Kajori Banerjee, Kolkata Municipal Corporation (KMC) councilor can also be selected in the working committee of the famous Rani Birla, the famous Rani Birla of Kolkata.
According to the law, the chairman of the management committee of a college should be a “person who is associated with education”, Justice Pattanayak called for a detailed hearing in the case, the chairman of the college work committee was just a councilor and there was no evidence that she was associated with academics.
The judge said, “Therefore, it needs to be seen whether his (Kajori Banerjee’s) appointment was legal or not.”
Subsequently, Kajori Banerjee contacted the Division Bench of Calcutta High Court Justice Tapabrata Chakraborty and Justice Ritobrata Kumar Mitra, who challenged the single-judge bench order.
However, on Friday, the Division Bench dismissed Kajori Banerjee’s petition and upheld the first order of the single-judge bench of Justice Pattanayak in the case.
The Division Bench also saw that the matter would be heard on the single-judge bench, with the next hearing in the case after eight weeks from now, as the first decision has been taken.
On 17 September, a bench of Justice Pattanak also migrated to the show-Hotis and suspension order by Kajor Banerjee last month to the college principal Sribanti Bhattacharya.
The interim migration will last for one and eight weeks, and the next hearing in the case will be after six weeks.
Show-causal notices and suspension orders were issued on 29 August.
The principal of the college challenged the show-causing notice and suspension order before the single-judge bench of Justice Biswaji Basu.
But during the hearing, the state government counsel requested Justice Basu to resume himself from the hearing in the case.
Justice Basu expressed pain on such an approach by the state government lawyer.
However, finally, he resumed himself from hearing the matter.
The case was then referred to for the bench of Justice Pattanayak.
The case came for hearing on 17 September, and at the end of the hearing that day, Justice Pattanayak also ordered an interim migration on both the show-causal notice and the suspension order.
