Bhim Koregaon case: SC Varawara Rao’s bail status declines to relax

New Delhi, 19 September (IANS) Supreme Court on Friday, 85 -year -old poet and activist P. Refused to entertain an application filed by Varawara Rao, who was an accused in the Bhima Koregaon case, requiring pre -permission from the trial court before the Greater Mumbai region.

Justice JK Maheshwari and Vijay Bishnoi appeared before a bench, representing senior advocate Anand Grover, Rao, that their clients have been on bail for four years and currently without family support in Mumbai when his wife moved to Hyderabad.

“Even today, he fell due to dizziness,” Grover told the Apex court, saying that Rao takes advantage of free healthcare in Telangana, his medical expenses in Mumbai are more than their monthly pension.

A bench led by Justice Maheshwari said, “The government will take care of their health… .. We are not interested (to entertain the application).”

Given the disintegration of the apex court to entertain the case, Grover sought permission to withdraw the application, which was allowed by Justice Maheshwari-led bench-without giving to Express Liberty to renew the petition in later phase.

In August 2022, the Supreme Court granted permanent bail to Rao at the medical ground, dismissing the NIA’s opposition that neither age nor medical condition could become a factor for bail for the accused of the UAPA (prevention) Act.

The court had ordered that the appellant should stay within Mumbai more until the trial court is allowed otherwise, avoid contacting the witnesses, and should avoid influencing the investigation.

The apex court violated the conditions for cancellation of bail to the appellant, “the apex court had clarified, stating that the bail was fully given on health basis and its observations did not reflect on the merit of the case.

This said, “The appellant will be entitled to the medical attention of his choice, but will keep the defendant officers in touch with any development that includes the attention of the medicine received by them.”
