Bengaluru, Nov 20 (IANS) A Bengaluru court on Thursday granted anticipatory bail to a 64-year-old senior citizen who was accused of rape by another senior citizen, his former girlfriend.

The case was registered at Bellandur police station in Bengaluru under sections 74, 78, 64 and 351 (2) of the Indian Code of Justice (BNS) and the accused had prayed for exemption from arrest.
During the proceedings, it emerged that the relationship between the parties was completely consensual and had been continuing for a long time, and it appears that the complaint was filed only after the complainant’s husband discovered the relationship.
The court also took note of allegations that the victim’s husband had attempted to exert influence by citing his connections and proximity to high-profile persons, including the former Vice President, and that senior police officers (Deputy Commissioner of Police) had repeatedly called the accused to settle the case.
The matter was argued over two dates by advocate Pratik Som, appearing for Delhi, and the court ultimately found it appropriate to grant relief in the anticipatory bail application.
The complainant said that she knew the accused and he often visited her when he was in Haridwar for naturopathy treatment.
She alleged that the accused took her to a room on the pretext of doing puja, closed the door and forced himself on her.
It is alleged that the accused tried to remove her clothes and threatened her not to make any noise.
Due to health reasons the complainant fainted and the accused fled from the spot.
Later, the accused came back, threatened her not to disclose the incident and dropped her to the airport.
After returning to Bengaluru, the victim lodged a complaint with the police.
The accused claimed that the FIR was false and filed with malicious intent.
He said that the complainant concealed the fact that she was willingly involved in an extramarital romantic relationship with him since 2019 and this relationship continued for several years.
The accused produced around 120 call records between the petitioner and the complainant over a period of 7.30 hours and claimed that the communications between them revealed that they had shared personal, intimate and sexual details of each other’s lives.
He also claimed that the content of the phone call clearly showed a deep emotional bond between them and that they entered into a consensual, emotional and sexual relationship.
The two exchanged the words ‘I love you’ on several occasions.
It was also brought to the notice of the court that the two exchanged the words ‘I love you’ at 10:30 pm on August 19, 2025, despite the fact that at 12 noon the petitioner is accused of trying to force himself on the victim.
The accused claimed that their relationship was known to the complainant’s husband and claimed that her husband put pressure on her and at his instance, she filed the complaint with the intention of saving her reputation and saving herself from social stigma.
While granting bail, the court said that the victim had actively participated in the conversation.
It appears that since the husband of the complainant came to know about the extramarital affair existing between the petitioner and the complainant, the complainant must have filed the complaint to please her husband and save her marriage.
The court also said that the accused voluntarily appeared before the investigating officer on November 3, 2025, but the officer did not deem it appropriate to interrogate him.
Keeping the facts in mind, the court granted bail to the accused senior citizen.
